In January we provided legal aid and psychological counseling to 24 women who suffered domestic violence beneficiaries of Legal Aid Center (LAC), for protection against domestic violence and resolution of the most common legal problems they faced, such as divorce, custody, child support, property division, and the realization of social protection rights. Some of the women faced specific challenges regarding compliance with decisions of the Social Work Center (SWC) regarding the regulation of parental rights, due to the refusal of children to contact the other parent (the father). In such situations, the women themselves were held accountable and criminal proceedings were initiated against some of them for the offense of "Seizure of a minor" (Article 198 of the Criminal Code). To address these legal problems, legal advice was provided regarding the initiation and progress of civil and criminal court proceedings for protection from domestic violence, as well as other court and administrative procedures in front of competent authorities. A total of 55 individual consultations with a lawyer were organized, and 21 written submissions were prepared in proceedings for divorce (6), custody (4), child support (3), criminal cases (3), and property disputes (2), and realization of social protection rights (3). We provided legal representation in a criminal proceeding for one client, and one client was financially supported for the payment of court costs in a civil court procedure for compensation for non-material damage suffered as a result of domestic violence. Psychological counseling was provided by a professional psychologist for 6 women.
Based on interviews conducted with 30 women who have experienced domestic violence and are either involved in or have been involved in legal proceedings to determine child support for their children, by the end of January 2024 we began processing the data and preparing the third consecutive analysis "Does court-ordered child support satisfies the children’s needs."The initial findings of the analysis indicate that the amount of court-ordered child support by the basic civil courts is not in line with the needs of the children, and an additional challenge is the non-payment of court-ordered child support by perpetrators of domestic violence. We use these findings to advocate for improvements in judicial practice and the establishment of special mechanisms for the effective collection of child support from parents who refuse to fulfill their parental obligations regarding the support of children.
This activity is part of the assessments we are preparing, with direct consultation with women who have experienced domestic violence, aiming to determine the level of utilization of legally guaranteed rights and other specific needs in accessing justice.
Координаторот на програмата за јавно здравје на Здружение ЕСЕ е вклучен во имплементацијата на проектот ,,Girls’ Leadership Initiative for Community Empowerment" кој се спроведува од страна на СИГА, а е поддржан од Германското друштво за меѓународна соработка ГИЗ, како дел од регионалниот проект ,,Социјално вклучување на ранливите групи на Западен Балкан”. Во рамките на овој проект координаторот од ЕСЕ учествуваше како обучувач на обуката која се одржа во периодот од 26 – 28 јануари, 2024. На обуката учествуваа граѓански активистки од општините Кочани, Пробиштип, Виница и Чешиново-Облешево. На обуката координаторот од ЕСЕ на учесничките им ги презентираше методологиите на социјална отчетност, како и методи за спроведување на овие активности во заедницата. Воедно на обуката обезбеди менторска поддршка на учесничките од општината Пробиштип да подготват план на активности за спроведување на активности за социјална отчетност на локално ниво со цел унапредување на услугите од патронажната служба во општина Пробиштип.
На настанот „Превентивна здравствена заштита на децата - Погодна за целта и отпорна“, организиран од страна на УНИЦЕФ на 25.01.2024 година, Координатор на програма од Здружение ЕСЕ ги презентираше клучните наоди и препораки од „Анализата за трошоците и придобивките од патронажната служба“. Анализата е подготвена од страна на персоналот на Здружение ЕСЕ во соработка со меѓународната експертка Деби Будлендер, за потребите на УНИЦЕФ како основа за инвестициски случај за соодветна распределба на финансиски средства за патронажната служба во примарната здравствена заштита во Северна Македонија. Наодите од анализата покажаа дека преку зголемени инвестиции во патронажната служба, како и со унапредена ефикасност во работата на оваа служба ќе се унапреди здравјето на мајките и децата во Р. С. Македонија, што исто така ќе резултира и со заштеди на финансиски средства. Унапредувањето на здравјето преку услугите обезбедени од патронажната служба пред се ќе се постигнат преку зголемен опфат на децата со вакцинација, зголемена стапка на доење на доенчињата, како и унапредена антенатална здравствена заштита и унапредена нега и грижа за новороденчињата и доенчињата.
In the first half of January 2024, as part of the preparation process for the National Action Plan for Open Government Partnership (NAP for OGP) 2024-2026, the commitment "Preventing violence against women and domestic violence" was finalized by the working group coordinated by ESE. It is expected that in the following period, the commitment will be adopted as part of the new OGP National Action Plan and it should contribute to improving access to justice for women who suffered domestic violence through the education of practitioners from relevant institutions and the judiciary, and a national campaign to raise public awareness of domestic violence and legal mechanisms for protection.
